Abstract

This study examines the dynamics of sentencing in cases of police misconduct, focusing on how the severity of the crime and the underlying motive influence judicial outcomes. Police misconduct, ranging from excessive force to corruption, presents complex challenges for the justice system, particularly in determining appropriate sentences. By analyzing a range of cases involving different types of misconduct, the research seeks to understand how the seriousness of the offense and the intentions behind the misconduct affect sentencing decisions. The study utilizes a combination of legal analysis and empirical data, including case reviews and interviews with legal experts, to identify patterns and discrepancies in sentencing. The findings highlight that while crime severity often correlates with harsher sentences, the role of motive introduces additional layers of complexity, affecting judicial discretion and outcomes. This research aims to provide insights into the factors shaping sentencing in police misconduct cases and to suggest potential reforms for ensuring more equitable and consistent judicial responses.
